1. Purpose and Scope
1.1. These Terms of Use (“Terms”) govern access to and use of the Maturity Lab institutional site, currently available at maturitylab-site.pages.dev and, in the future, at maturitylab.com (the “Site”), maintained by Atomtech Tecnologia da Informação LTDA, registered under CNPJ No. 15.713.995/0001-05, with its registered office at SMPW Quadra 05, Conjunto 14, CEP 71735-514, Brasília/DF, Brazil (“Atomtech”, “we”).
1.2. The Site has an informational and interest-capture purpose: to present the Maturity Lab product and its lines (including the CertReady line), to allow messages to be sent through the contact forms, and to allow sign-up for the waitlist and any pre-launch programs.
1.3. Essential distinction between the Site and the Maturity Lab service. These Terms cover exclusively the institutional Site and the waitlist. The Maturity Lab software service (an organizational maturity assessment platform, to be made available at app.maturitylab.com or an equivalent address) is a distinct product and, when available for purchase, will be governed by its own terms and conditions, accepted at the time of purchase. Accessing the Site and signing up for the waitlist do not create a contractual relationship regarding the software service, do not grant a right of access to it, and are not to be confused with its eventual purchase.
This site is the storefront. The paid program is something else, with its own contract.
2. Definitions
For the purposes of these Terms:
- Atomtech: Atomtech Tecnologia da Informação LTDA, the maintainer of the Site.
- Site: the Maturity Lab institutional site described in clause 1.1.
- User: any person who accesses or uses the Site, with or without signing up for the waitlist.
- Waitlist: voluntary registration of interest in the launch of Maturity Lab, with no contractual nature (clause 4).
- Founder Program: pre-launch promotional conditions that may be offered to interested parties, subject to confirmation (clause 4).
- Site Content: text, images, visual identity, trademarks, layout, code, and other materials made available on the Site.
- Maturity Lab Service: the maturity assessment software, subject to its own contract, outside the scope of these Terms.
3. Acceptance, Capacity, and Audience
3.1. By accessing and using the Site, the User declares that they have read, understood, and agree to these Terms. If they do not agree, they must refrain from using the Site.
3.2. By submitting any Site form (contact, waitlist, model request, or similar), the User expresses specific and unequivocal agreement with these Terms and the Privacy Policy, by checking the corresponding acceptance field.
3.3. The Site is not directed at people under 18 and does not intentionally collect minors' data. By using it, the User declares that they are of legal age and fully capable, or duly represented/assisted as provided by law.
4. Waitlist and Founder Program
4.1. Signing up for the waitlist is free and voluntary and is intended to register the User's interest in the launch of Maturity Lab and to allow related communications.
4.2. Signing up for the waitlist does not constitute a contract, binding offer, reservation, or guarantee of access to the service, of a spot, of a launch date, of functionality, or of price.
4.3. Any conditions of the Founder Program or other pre-launch programs (including discounts, promotional periods, or benefits) are merely informational and subject to confirmation, and may be changed, suspended, or canceled at any time, without giving rise to any obligation for Atomtech. The effective conditions will be those in force and formalized at the time of any purchase of the service, under the terms then applicable.
4.4. The User may request the removal of their data from the waitlist at any time, as set out in the Privacy Policy.
5. Intellectual Property
5.1. All Site Content — including the “Maturity Lab” trademark, the CertReady name, text, visual identity, logos, layout, information architecture, illustrations, source code, and methodological materials — is owned by or licensed to Atomtech, and is protected by intellectual property and copyright law.
5.2. The User is granted a limited, personal, non-exclusive, non-transferable, and revocable license to access and view the Site Content for informational purposes. This license does not transfer any ownership rights.
5.3. Except with Atomtech's prior written authorization, it is prohibited to: reproduce, distribute, publish, modify, create derivative works, reverse engineer, or commercially exploit the Site Content, in whole or in part.
You may read and browse; you may not copy, resell, or appropriate the content and the trademarks.
6. Third-Party Trademarks and Frameworks (Disclaimer)
6.1. Maturity Lab and the Site refer to third-party methodologies, standards, frameworks, and seals — for example, and without limitation, MEG/FNQ, ISO/ABNT standards, B Corp/B Lab, among others — solely for methodological and educational reference purposes.
6.2. All trademarks, names, and distinctive signs mentioned belong to their respective owners. Citing these references does not imply, and must not be interpreted as, any affiliation, partnership, licensing, sponsorship, endorsement, accreditation, or official certification by the owner entities.
6.3. Maturity Lab is a diagnostic and readiness-assessment tool. It does not issue official certification for any standard or scheme, does not replace accredited certification bodies or assessors, and its results are not equivalent to certification, accreditation, or formal conformity.
6.4. The Site does not reproduce the full text of standards protected by copyright (in particular ISO/ABNT standards); references are limited to identifying the standard, the topic, and content of Atomtech's own creation. Third-party logos, when displayed, are not used as a seal of conformity or certification.
We cite standards and seals only as a reference. We are not partners or official certifiers, and Maturity Lab does not issue a certificate for any standard.
7. Acceptable Use and Prohibited Conduct
7.1. The User undertakes to use the Site lawfully and in good faith. Among other conduct, it is prohibited to:
- use the Site for unlawful, fraudulent purposes or those that violate third-party rights;
- attempt to bypass, test, or compromise the Site's security mechanisms;
- submit, through the forms, unlawful, offensive, defamatory content, spam, or unsolicited bulk communication;
- enter false data, third-party data without authorization, or impersonate another person;
- carry out automated data collection (scraping), scanning, or massive content extraction in an abusive manner or one that overloads the infrastructure;
- introduce malicious code, viruses, or any agent capable of harming the Site or its users;
- use the Site Content in violation of clause 5.
7.2. Noncompliance authorizes Atomtech to adopt the measures in clause 13, without prejudice to applicable legal sanctions.
8. Content and Information Submitted by the User
8.1. By sending messages or data through the Site forms, the User declares that the information is true, their own, or duly authorized, and is responsible for its content.
8.2. The User grants Atomtech a limited license to use the information submitted strictly to respond to the contact, manage the waitlist, and follow up on the interest expressed, under the terms and purposes described in the Privacy Policy.
8.3. The Site forms are not intended for sending confidential, sensitive, or secret information. The User must not send sensitive data (art. 11 of the LGPD) through these channels.
Send only what we need to get back to you. This is not a channel for confidential or sensitive information.
9. Site Availability
9.1. Atomtech will use reasonable efforts to keep the Site available and functional, but does not guarantee uninterrupted, error-free, or interruption-free availability, and may carry out maintenance, updates, or suspensions at any time.
9.2. The Site is provided “as is” and “as available”. Because it is a free institutional site, no service levels (SLA) apply — any availability commitments will concern only the Maturity Lab service, under its own terms.
10. Third-Party Links and Resources
10.1. The Site may contain links to third-party sites, content, or services. Such links are offered for convenience and do not imply endorsement.
10.2. Atomtech does not control and is not responsible for the content, policies, or practices of third-party sites. Access to them is the User's sole responsibility, subject to their respective terms and policies.
11. Disclaimer of Warranties and Limitation of Liability
11.1. To the fullest extent permitted by applicable law, the Site and its Content are provided without warranties of any kind as to accuracy, timeliness, fitness for a particular purpose, or results arising from their use. The Site information is general and informational in nature and does not constitute professional advice (legal, accounting, management, or certification).
11.2. To the fullest extent permitted by applicable law, Atomtech will not be liable for indirect damages, lost profits, or losses arising from decisions made based on the Site Content.
11.3. Nothing in these Terms excludes or limits liabilities that cannot be waived by law, in particular those arising from the Consumer Protection Code where applicable.
12. Privacy and Data Protection
12.1. The processing of personal data within the Site is governed by the Privacy Policy, which is an integral and complementary part of these Terms.
12.2. The Privacy Policy details the data processed, purposes, legal bases, processors, international transfer, retention, and the data subject's rights (art. 18 of the LGPD), as well as the DPO channel: [email protected].
13. Suspension and Blocking of Access
13.1. Atomtech may, at its discretion and without prior notice when necessary to protect the Site or third parties, restrict, suspend, or block the access of a User who violates these Terms, engages in prohibited conduct (clause 7), or poses a security risk, without prejudice to applicable legal measures.
13.2. The removal of the User's data from the waitlist, upon request or due to inactivity, will follow the Privacy Policy.
14. Changes to these Terms
14.1. Atomtech may change these Terms at any time. The version in force will always be the one published on the Site, with an indication of the version and the date of “Last updated”.
14.2. Material changes will be informed through an appropriate means (a notice on the Site and/or, where there is contact, by email) and, when they require renewed consent for data processing, through a new acceptance.
14.3. Continued use of the Site after the changes take effect implies agreement with the updated version.
15. General Provisions
- Severability of clauses. The invalidity of one clause does not affect the others, which remain in force.
- Forbearance. Atomtech's failure to enforce any provision does not constitute novation or waiver.
- Assignment. The User may not assign rights or obligations under these Terms. Atomtech may assign them in the event of a corporate reorganization, upon notice.
- Force majeure. Atomtech is not liable for failures arising from events beyond its reasonable control (fortuitous events, force majeure, third-party infrastructure failures).
- Entirety. These Terms, together with the Privacy Policy, constitute the entire understanding between the parties regarding the use of the Site.
16. Governing Law and Forum
16.1. These Terms are governed by the laws of the Federative Republic of Brazil.
16.2. The courts of the Judicial District of Brasília/DF are elected to settle disputes arising from these Terms, with waiver of any other, however privileged.
